Justice Kagan Temporarily Blocks Phone Record Access

January 6 House Select Committee must wait for further review of the case.

Supreme Court Justice Elena Kagan has granted a temporary injunction against the access to phone records sought by the House Select Committee investigating the events of January 6, 2021. The justice temporarily blocked the panel from accessing the phone records of Arizona part chair Kelli Ward and her husband, Mark Ward.  

Justice Kagan’s brief order temporarily enjoined the mobile provider “from releasing the records requested by the House Select Committee pending further order of the undersigned or of the Court.“ 

“It is further ordered that a response to the application be filed on or before Friday, October 28, 2022, by 5 p.m. (EDT).” 

The Wards had sued to block access to their phone records. After losing their case at the district court level, they appealed, but the U.S. Court of Appeals for the 9th Circuit voted 2-1 to deny their bid to protect their records. 

Justice Kagan is assigned to the Ninth Circuit, so she handles emergency appeals from the state of Arizona.
